1. Agreement to Terms

By accessing or using LemonPop ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including but not limited to users who are contributors of content, information, and other materials or services on the Service.

2. Description of Service

LemonPop is a platform that enables users to generate and build custom business tools and software using AI-powered tools. The Service includes:

• AI-powered software and tool generation
• Code export and download capabilities
• Database management tools
• API configuration interfaces
• Version history and tracking
• File and image upload functionality

3. Subscription Plans and Billing

3.1 Free Tier

LemonPop offers a free tier that includes 2 AI generations per month. This tier is designed to allow users to trial the platform before committing to a paid subscription.

3.2 Paid Subscriptions

Paid subscription plans (PRO, ULTRA, and MAX) are billed on a recurring basis, either monthly or annually, depending on your selection. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis.

3.3 Payment

All payments are processed securely through Stripe. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Service. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions.

3.4 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date. You may cancel your subscription at any time through your account settings or by contacting our support team.

3.5 Refunds

Refunds are handled on a case-by-case basis. If you believe you are entitled to a refund, please contact our support team within 14 days of your purchase. We reserve the right to refuse refunds for services already rendered or for violations of these Terms.

4. Usage Limits and Fair Use

Each subscription plan includes a specified number of AI generations per month. Usage limits reset at the beginning of each billing cycle. Unused generations do not roll over to the next billing period.

We reserve the right to monitor usage and enforce fair use policies. Excessive use that significantly exceeds normal usage patterns may result in temporary suspension or throttling of service.

5. Intellectual Property Rights

5.1 Your Content

You retain all ownership rights to the code, applications, and content you create using LemonPop. By using the Service, you grant us a limited license to host, store, and process your content solely for the purpose of providing the Service to you.

5.2 Our Platform

The Service and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of LemonPop and its licensors. The Service is protected by copyright, trademark, and other laws.

6. Acceptable Use Policy

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Transmit any viruses, malware, or other malicious code
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Use the Service to compete with LemonPop or create a similar service
• Resell, redistribute, or sublicense the Service without explicit written permission

7. Account Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting our support team or through your account settings. Upon termination, you will lose access to all generated applications and data stored on our platform.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We collect, use, and protect your personal information in accordance with applicable data protection laws.

We implement industry-standard security measures to protect your data. However, no method of transmission over the Internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your data, we cannot guarantee its absolute security.

9. Disclaimers and Limitations of Liability

9.1 Service Availability

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

9.2 Generated Code

While we strive to generate high-quality code, we do not warrant that the generated code will be free from bugs, errors, or security vulnerabilities. You are responsible for reviewing, testing, and validating any code generated by the Service before deploying it in a production environment.

9.3 Limitation of Liability

In no event shall LemonPop, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

10. Indemnification

You agree to defend, indemnify, and hold harmless LemonPop and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of and access to the Service, or your violation of these Terms.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which LemonPop operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of that jurisdiction.
